1.1 Contracting Party
These Terms and Conditions (the “Terms”) constitute a legally binding agreement between you and Pawnfind LLC, a limited liability company incorporated in the State of Delaware, USA (hereinafter, “Pawnfind”, “we” or the “Platform”). By accessing, browsing, or using pawnfind.com, its subdomains, the mobile application, or any other related service (together, the “Platform”), you (“User”, “Service Provider” or, collectively, the “Parties”) acknowledge that you have read, understood, and agreed to these Terms.
1.2 Purpose
Pawnfind provides a technology Platform allowing (i) Users – pet owners or caretakers – to search, compare, and book pet lodging services offered by (ii) Service Providers. Pawnfind acts only as an intermediary, facilitating lodging contracts between Users and Service Providers and managing payments, without being a party to the lodging contract or a direct service provider.
1.3 Acceptance and Validity
By checking “I accept the Terms and Conditions,” creating an account, or otherwise using the Platform, you accept these Terms and related policies (Privacy Policy, Cancellation and Refund Policy, Community Guidelines). If you do not agree, you must refrain from using the Platform. These Terms become binding only upon express acceptance at registration or booking.
1.4 Modifications
Pawnfind may modify these Terms at any time. Updates will be posted with a “Last Updated” date and substantial changes will be notified at least 15 days in advance by email or via the User account. Continued use after the effective date constitutes acceptance.
1.5 Eligibility
To use the Platform, you must:
- Be at least 18 years old or legal majority in your jurisdiction
- Have full legal capacity
- Not have been suspended or banned previously
1.6 Language Priority
These Terms may be translated. In case of discrepancy, the Spanish version prevails.
1.7 Related Documents
The following policies form part of these Terms: Privacy Policy, Cancellation and Refund Policy, Commissions and Payments Policy (including 12% Service Provider fee and 3% User fee), and Pawnfind Community Guidelines. By accepting these Terms, you agree to comply with them.
2. Definitions
3. User Account and Registration
Registration is required to use the Platform. You must provide accurate, complete information and update it. Identity verification and valid payment methods (Stripe/PayPal) may be required. Service Providers must provide licenses, permits, and establishment details. You are solely responsible for your account and password security.
Accounts are personal and non-transferable. Company accounts require proof of authority. Pawnfind may suspend or terminate accounts for violations, false data, fraud, animal abuse, or inactivity over 12 months. Users may request account closure, which does not waive existing obligations.
4. Bookings and Payments
Users select dates and options, accept total price, and authorize charge. Booking is confirmed when accepted by Service Provider or automatically after the acceptance period. Escrow holds Lodging Fee + 3% User Fee + taxes, releasing net payment (minus 12% Service Provider commission) 24h after check-in. All transactions in USD. Disputes or chargebacks may withhold funds. Security deposits may apply.
5. Commissions and Billing
User Service Fee: 3% of subtotal, visible at booking.
Service Provider Commission: 12% of Lodging Fee, deducted before payout.
Invoices: Pawnfind issues receipts to Users and commission invoices to Service Providers. Taxes and withholdings may apply by law (e.g., Costa Rica IVA 13%, IRS backup withholding). Service Providers must comply with local invoicing and tax obligations. Pawnfind provides annual financial reports.
6. Cancellations and Refunds
Service Providers must choose one policy: Flexible, Moderate, or Strict. Refunds to Users depend on timing of cancellation (≥24h, ≥5 days, ≥16 days, etc.). Indirect taxes refunded proportionally. Provider cancellations result in full refund to User and may trigger penalties.
Penalties: Negligence (unsanitary conditions, false info, unjustified cancellation) incurs penalties: 12% of Lodging Fee or $25.
No-shows follow cancellation rules. Force Majeure events reviewed case by case. Refunds processed to original payment method within 10 business days.
7. Obligations and Responsibilities
User Obligations
- Provide truthful pet data

- Authorize emergencies
- Comply with check-in/out
Service Provider Obligations
- Maintain valid licenses
- Ensure safe facilities
- Trained staff
- Incident reporting
- Accurate calendars and records
Pawnfind Responsibilities
Technology intermediation, document verification, dispute resolution. Liability for damages managed via insurance or direct responsibility.
8. Insurance and Safety
Insurance is recommended but not mandatory. Providers with valid COI ($25,000 minimum liability) may display a badge. Without insurance, Provider assumes all liability. Claims must be reported within 2h, supported with evidence, and filed with insurers within 5 days.
Safety standards include: fencing, CCTV, emergency plans, sanitation, and zoonosis prevention. Certifications may increase visibility. Non-compliance may suspend listings.
9. Prohibited Conduct
Strictly Prohibited:
- Animal abuse
- False information
- Payment fraud
- Discrimination
- Off-platform transactions
- Price alterations
- Misuse of personal data
- System manipulation
- Illegal activities
Violations may cancel bookings, suspend accounts, reverse payments, and be reported to authorities. Users may appeal within 5 days.
10. Reviews and Feedback
Reviews allowed only after completed bookings, within 14 days, with ratings and optional photos. Offensive, fraudulent, or irrelevant reviews may be removed. By submitting, you grant Pawnfind a worldwide, irrevocable, sublicensable license to use reviews. Ratings impact listing visibility. Manipulation is prohibited.
11. Intellectual Property
Pawnfind LLC owns all copyrights, trademarks, patents, trade secrets, and brand elements. Users receive a limited, non-transferable license to access content for legitimate use. User Content must be owned/licensed and grants Pawnfind global use rights.
Unauthorized use, scraping, or third-party trademark misuse is prohibited. DMCA takedown requests may be filed. Pawnfind reserves legal actions.
12. Data Protection and Privacy
Pawnfind complies with Costa Rica Law 8968, EU GDPR, and California CCPA. Data collected includes identification, contact, pet, financial, and usage data.
Purposes: service provision, fraud prevention, communication, marketing (opt-in), analytics.
Data shared with: payment processors, insurers, authorities, and vendors.
Data retention: 5 years for account/tax, 3 years for chats, 12 months for logs.
Rights: access, rectification, erasure, objection, portability. Requests: privacy@pawnfind.com. TLS/AES encryption, MFA, audits, and limited cookie use.
13. Indemnification and Limitation of Liability
Pawnfind provides the Platform ‘as is.’ No warranties of uninterrupted service or accuracy of User Content. Liability limited to the greater of User Fee charged or $100. Excludes indirect damages.
Users and Providers indemnify Pawnfind for breaches, misuse, pet damages, or law violations. Pawnfind indemnifies only for proven gross negligence or willful misconduct.
14. Dispute Resolution and Arbitration
Parties must first attempt resolution via Platform’s Resolution Center (15 days). Mediation may follow, costs split. If unresolved, binding arbitration under AAA rules in Wilmington, Delaware applies.
Language: Spanish or English
Law: Delaware
Small claims court: Allowed for minor disputes
Class actions: Waived; only individual claims permitted
Time limit: 12 months
Arbitrator may order interim measures.
15. Amendments to Terms
Pawnfind may revise Terms due to legal changes, new features, or market adjustments. Updates posted with ‘Last Updated’ date and 15 days’ notice for substantial changes. Continued use implies acceptance. Users may close accounts if they disagree before effective date.
16. Governing Law and Jurisdiction
Delaware law governs, subject to mandatory local laws. Disputes resolved by arbitration (Section 14). Residual jurisdiction lies with Delaware state/federal courts for injunctions, award enforcement, or unresolved matters.
Mandatory local consumer/welfare laws prevail when applicable. Spanish version is the binding one; translations are for convenience.
